GREENFIELD — Franklin County Superior Court accepted the change of plea of an Orange man facing 28 counts of possession of child pornography last week.
Eric R. Barr, 44, submitted an unagreed plea to 25 of the counts on Dec. 10. An unagreed plea means the prosecutor and the defense don’t agree on all the terms of the plea.
The Commonwealth is seeking a sentence of between four and five years in state prison on nine of the counts, according to Northwestern District Attorney’s Office spokesperson Mary Carey. On the remaining counts, Carey said, the Commonwealth is seeking probation for five years after his state prison sentence and requesting GPS monitoring be imposed.
Barr’s legal counsel is advocating for probation for five years on all the counts and is opposed to the state’s request for GPS monitoring.
According to Carey, sentencing will be delayed pending a sex offender evaluation by a qualified examiner. The court will decide which sentence will be imposed once Barr undergoes the evaluation.
The next scheduled court date is Feb. 14, 2020.
