When ICE descends on Massachusetts in force, who can protect us?ย ย
No one, according to the Trump administration. It claims that federal immigration agents enjoy absolute immunity and that the state is helpless, impotent, to protect itself and its people from crimes they commit.
Butย according toย localย constitutional warriorย John Bonifaz, president and co-founder ofย theย Amherst-basedย national organization,ย Free Speech for People,ย speakingย on local and national mediaย has characterized that assertion asย โa complete fabrication.โย
Donald Trump and JD Vanceย assert thatย the Constitutionโsย Supremacy Clauseย (โThe laws of the United States โฆ shall be the supreme law of the landโ)ย meansย thatย states haveย no authority overย ICE andย otherย federal law enforcement,ย noย ifs,ย ands or buts.ย
Theyโre lying. The Supremacy Clauseย onlyย providesย immunityย when agentsโ actionsย ย areย โnecessary and properโย to carry out their duties.ย ICEย agents have no rightย to commit homicides or to kidnap, commit assault and battery, destroy property or break and enter and trespass in a residence.ย No federal law authorizes them to commit state crimes. None.ย
In Minneapolis weโveย witnessedย the horrifying results of this assertedย immunity โtheย shootingsย ofย Reneeย Goodย (fatally in her head),ย Alexย Prettiย (fatally in his back)ย andย Julian C. Sosa-Celisย (in his leg).ย In response federal officialsย haveย liedย and liedย and liedย some more;ย claimedย the victims areย โdomestic terroristsโย and criminals;ย micro-managedย cover-ups. Thank God forย cell phones andย videos.ย
Across the country federal agents have been acting like an occupying force. As theyย decamp from Minneapolisย claimingย success,ย the fearful questionย is,ย whichย communityย is next?ย
ย Massachusetts Attorney General Andrea Campbell,ย to her credit, has challenged the โmilitarized and illegal deploymentsโ of federal officers. Her recentย amicusย brief supporting Minnesotaย in a civil caseย asserted that โ(t)he Trump administrationโs reckless enforcement of cruel immigration policies is irresponsible, jeopardizes the safety of our communities, and undermines state and local governmentsโ ability to deliver basic services and protections to their residents.โย ย
And going about as far as she canย givenย ongoing investigations,ย sheโs stated that Renee Goodโs deathย โcould be murder.โย ย
So far so good. But we will need more. We will need Attorneyย Generalย Campbell to publicly, clearly and emphatically pledge that she will investigateย and indictย federalย agentsย who violate our criminal laws.ย Keep it simple:ย ICE agents,ย if you breakย the lawย here,ย youโreย goingย toย state prison.ย ย
ICEย agents,ย of course, haveย been operatingย in Massachusetts, abducting and detaining people and committingย someย stateย crimes.ย What we have not yet endured isย a massiveย federal deployment like those in Minneapolis,ย Los Angeles,ย Chicago, Portland, and Washington D.C.ย
Timing matters.ย The AGย shouldnโtย precipitously paint a target onย our back for Trump.ย Butย neither canย sheย unduly delay.ย Instillingย fearย of state prosecutionsย couldย well tamp down the size ofย DHS and ICEโsย occupying forceย andย alsoย reduceย the number and severity of the crimes thatย federal lawย enforcement officersย willย commit.ย
Both the attorney general and district attorneys prosecute crimes.ย Theyย canย work togetherย andย employย state and municipal policeย andย investigativeย resourcesย to ferret out facts and garner evidence.ย And they should.ย ย ย
Here the district attorney forย Hampshire andย Franklin Counties,ย David Sullivan, has pledged to investigate and prosecute federal agents whoย breakย the law.ย Anย example:ย youโreย exercising yourย constitutional and statutory right to film ICE agents. An agent, unhappy about being captured on video,ย strikes and detainsย you. Thatโsย assault and battery.ย ย
โNo person is above the law,โ Sullivanย insists.ย โIf they violate a state criminal law โฆ then we have the right to charge those officials and certainly (take the case) through the state system.โ The otherย Massachusettsย district attorneys should stand shoulder to shoulder with Sullivan on this.ย
A caveat. These prosecutions will not be easy. Theyย willย faceย problems of proof, starting with identification of the masked perpetrators.ย Theย feds willย claimย thatย the person they assaulted was interfering.ย Theyโllย stonewall state investigators.ย And the defendant federal officers willย do somethingย other state criminal defendantsย cannot โ remove the case to federal court, where theyโllย assert immunity.ย Theseย defendants willย have unlimited resources,ย includingย video and otherย experts galore. And so on.ย ย
Problematic? Sure,ย but not insurmountable.ย ย
The Tenth Amendment, the final provision in the Bill of Rights, providesย thatย all the powers not specifically given to the federal government โare reserved to the states respectively or to the people.โย This means that state law enforcement has the rightย (and many say the obligation)ย toย prosecuteย the crimes discussed here.ย In sum, the Constitution is on our side.ย ย
Whenย ICE arrives,ย weย the peopleย mustย resist and protest as the goodย people of Minneapolis have.ย Courageย will be requiredย givenย theย casualty count.ย
Forย resistanceย to workย weย will need to relyย onย neighbors, friendsย andย alliesย andย state andย localย leaders.ย Our DAs and attorney generalย must use allย availableย toolsย to prevent and punishย federal law enforcementโsย lawlessness.ย At its core this isย a straightforwardย proposition:ย Massachusetts can and must hold federal agentsย to account.ย ย
