Matthew A. Mogelinski, 23, of North County Road, Leyden. Charges of larceny over $250 by false pretense, attempt to evade a tax, and making a false statement in application for a motor vehicle title, in Leyden by state police, were not prosecuted, as according to a written statement from a counsel in the district attorney’s office, as a basis of this nolle prosequi the commonwealth states that with respect to counts two and three, a certificate of title has been provided by the defense counsel, and given to the named victim. With respect to count one, there is evidence, via text messages, that the defendant and victim discussed the physical condition of the car, and a settlement was reached for a reduction in the price of the vehicle. As a result, this action is appropriate and in the best interest of justice.

Marc A. Saulnier, 22, of Keegan Lane, Greenfield. Admitted to sufficient facts for operating under the influence of liquor, second offense, in Charlemont by state police, placed on probation until 5/30/18, with two-year loss of license, plus $500 fine, and $100 surfine, head injury assessment of $250, and victim witness assessment of $50, and must have no alcohol, and subject to testing. Must take and complete 14-day inpatient alcohol education program, and take any aftercare recommended, and pay the fee of $1,050.
