‘Millionaire tax’ constitutional

I am tired of seeing every mention of the “millionaire tax” referred to as being unconstitutional. The Massachusetts Supreme Judicial Court did not find the tax unconstitutional; it found the ballot initiative that mixed the “millionaire tax” and the use of such funds as a mix of purposes that violated what the constitutional allowed for ballot initiatives.

A ballot question to allow a so-called “Millionaire tax” has in fact been on the ballot before, five times in fact, and so far been voted down. This is part of continuing effort to provide the same graduated taxation in Massachusetts that is used in the federal income tax. That this is mis-stated is largely due to sloppy and partial reporting by the AP. For exact court ruling, see: SJC-12422 CHRISTOPHER ANDERSON & others1 vs. ATTORNEY GENERAL & others.2 https://www.mass.gov/files/documents/2018/06/18/124b22.pdf
