Orange, June 27, Judge David S. Ross

Dane M. Wilson, 33, of Phillipston. Found not guilty following a jury trial on charge of operating under the influence of liquor or 0.08 percent in Athol. Pleaded guilty to negligent operation of a motor vehicle. To be dismissed on payment of $160 fine, plus $40 surfine, head-injury assessment of $250, and victim-witness assessment of $50, following the jury trial. Judge Ross recommends a 60-day loss of license not be imposed. Charges of possessing an open container of alcohol in a motor vehicle, and speeding in violation of special regulation, were dismissed when motions for required findings of not responsible were both allowed by the judge.

Orange, June 28, Judge David S. Ross

Charles W. Guy Jr., 41, of Riceville Road, Athol. Charge of assault and battery on family/household member, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the alleged victim in this case has asserted her Fifth Amendment right not to testify against the defendant. Without her testimony, the Commonwealth will not be able to sustain their burden of proof at trial, and can no longer prosecute this case.

Must take and complete the driver alcohol education program, and pay the fee of $726.80. Charge of leaving the scene of property damage, dismissed on request of the Commonwealth. Must make $100 restitution to a named person. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month, but may be waived while paying on restitution.

Charges of unlicensed operation of a motor vehicle, and being a vehicle operator refusing to identify him or herself, were both dismissed on request of the Commonwealth. Found not responsible for no license in possession, no registration in possession, and miscellaneous motor vehicle equipment violation.

Mark Terounzo, 44, of Caldwell Road, Northfield. Admitted to sufficient facts for assault and battery, amended down from indecent assault and battery on a person 14 or over, but continued without a finding until 1/16/19, with victim-witness assessment of $50. Must have no alcohol and subject to screens and testing. Must stay 10 yards away from and have no contact with a named person. Must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Charge of selling or delivering liquor to a person under 21, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the court has accepted the agreed upon plea as to count one of this complaint. Must pay probation supervision fee of $65 per month.

Bail set at $1,500 cash or $15,000 surety, must have no drugs or alcohol, and subject to screens/tests, and must comply with the Scram unit, but the defendant was ordered held until the Scram unit could be applied, and he was brought to court on 7/12/17 to establish the unit, and on 7/14/17 the bail was posted and the Scram was established. The case was then continued until 8/3/17 for pretrial conference.
