Mark L. Burgess, 50, of Springfield. Charges of operating under the influence of liquor or 0.08 percent, fourth or greater offenses, operating without an ignition interlock, and operating a motor vehicle with suspended license for operating under the influence of liquor, were not prosecuted, as, according to a statement made by the District Attorney David A. Sullivan, the defendant has been indicted and arraigned in the Superior Court.

Must pay counsel fee of $150, or perform 16 hours of community service.

Charge of assault and battery with a dangerous weapon, to wit, a knife, different date from previous case, sentenced to two and a half years in the house of correction, 136 days direct, with balance suspended, placed on probation until 4/3/19, with victim-witness assessment of $90, and must stay away from and have no contact with a named person. Charge of attempted murder was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the named victim didn’t appear for a bind over hearing after being notified for his requirement to appear. In addition, the defendant has pled guilty and has been sentenced on a count of alleging assault and battery with a dangerous weapon, to wit, a knife. Must pay legal counsel fee of $150.
