BERNARDSTON — A Bernardston man is scheduled to appear in Framingham District Court on May 9 for a compliance hearing related to child rape charges he faces.
Raymond G. Phelps, 25, of 54 River St., has been charged with rape of a child and enticement of a child under the age of 16 after police say he sexually assaulted a minor he met on the internet. Phelps pleaded not guilty at his Feb. 21 arraignment. Judge Ellen Caulo set bail at $5,000 cash and is forcing Phelps to wear a GPS monitoring bracelet, have no contact with the alleged victim, and not use social media. According to the court, Phelps posted bail.
According to the Massachusetts Courts website, a compliance hearing is used to determine if the pretrial conference report is complete and, if necessary, to order appropriate penalties for non-compliance. The defendant can also enter a plea or admission and decide if they want to waive the right to a jury trial. If not, a trial date or trial assignment date can be scheduled.
Middlesex District Attorney spokeswoman Elizabeth Vlock said Phelps is represented by Daniel Cappetta. The prosecutor assigned to this case is Assistant District Attorney Courtney Linnehan.
Cappetta did not have an immediate comment when contacted by The Recorder.
