Jason R. Ruttle, 45, of Hope Street, Greenfield. Found guilty for assault and battery on family/household member, placed on probation until 11/28/17, with victim witness assessment of $50, and must have no abuse of the victim, must have no alcohol and subject to screens and testing, must have a SCRAM unit applied but may be removed after six months if no possession or screens, must attend AA meetings three times a week, and must take and complete the certified batterer’s intervention program. Charges of strangulation or suffocation, and possessing a Class C drug, to wit, Clonazepam, were dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month, but may be waived while in the batterer’s program.

Charge of assault and battery family/household member, in Ashfield by state police, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after reviewing all the facts and circumstances in this matter, and taking into account information provided by the named victim (listed) this is in the best interest of justice. Pleaded innocent to assault and battery on family/household member, kidnapping, intimidating a witness, juror, police, or court official, and assault with a dangerous weapon, to wit, an aluminum bat, ordered held for dangerousness hearing, c276 allegation of abuse under 276, section 56A found, and continued to 12/2/16 for the dangerousness hearing. Douglas Dawson, 32, of North Adams. Admitted to sufficient facts for negligent operation of a motor vehicle, in Charlemont by state police, but continued without a finding until 5/29/17, with restitution yet to be determined. Found not responsible for charges of tire tread depth violation, marked lanes violation, and failure to wear a seat belt.
Gabriel D. Lapollo, 40, of Birnam Road, Northfield. Pleaded guilty to operating under the influence of liquor, but continued without a finding until 11/28/17, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $707.76. Found not responsible for charges of failure to stop/yield, and marked lanes violation. Must pay probation supervision fee of $65 per month.
Luis E. Molina, 23, of Springfield. Pleaded innocent to unlicensed operation of a motor vehicle, and failure to drive in the right lane, in Whately by state police, released on personal recognizance, continued to 2/10/17 for pretrial conference.
