Charge of operating under the influence of liquor, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, as a basis for this nol pross, the Commonwealth states that after reviewing all of the evidence and speaking with the witnesses who would testify at trial, we would be unable to prove a necessary element of the charge, operation of a moor vehicle; neither the civilian witnesses nor the police department observed the defendant operating his motor vehicle; when Greenfield Police Department responded to the scene, the defendant’s car battery was dead and the vehicle was inoperable; officers made observation that the defendant appeared to be intoxicated, and located alcohol containers near the scene; without evidence of operation, the Commonwealth can’t sustain its burden at trial.
