Jami L. Frates, 38, of Main Street, Athol. Pleaded innocent to assault and battery, amended down from assault and battery on a family or household member, and a charge of intimidating a witness, juror, police, or court official, released on personal recognizance, no allegation of abuse under C276a, section 56A found, continued to 11/15/16 for pretrial conference. Must pay counsel fee of $150, or perform 16 hours of community service.

Markus W. Luchock, 23, of Winchendon. Admitted to sufficient facts for unlicensed operation of a motor vehicle, but continued without a finding until 12/2/16 with victim-witness assessment of $50. Found not responsible for motor vehicle lights violation. Must pay $50 per month probation supervision fee.

Colin F. Leon, 27, of Sudbury. Pleaded innocent to operating under the influence of liquor, but continued without a finding until 10/2/17, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $707.76. Must have mental health evaluation and take any after-care recommended. Found not responsible for speeding, Charge of Negligent operation of a motor vehicle, dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month, or perform eight hours a month to community service.

Benita Dykeman, 48, of Main Street, Athol. Charge of assault and battery on family/household member, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, no contact from the victim.

Travis Richardson, 25, of Main Street, Athol. Pleaded innocent to unlicensed operation of a motor vehicle, and negligent operation of a motor vehicle, released on personal recognizance, continued to 10/21/16 for pretrial conference.

Wesley S. Powell, 29, of Chester Street, Athol. Pleaded guilty to assault and battery with a dangerous weapon, to wit, a door, sentenced to one-year in the house of correction, 30 days direct, balance suspended until 10/1/19, must obey all jail rules, given credit for time served, must take and complete a substance abuse evaluation, and take any after-care treatment recommended, and must have mental health evaluation and take any after-care recommended. Pleaded guilty to improper storage of a firearm, amended down from improper storage of a large capacity firearm, sentenced to one year in the house of correction, 30 days direct, with balance suspended to 10/1/19, and with all other conditions listed in count one. Pleaded guilty to discharging a firearm within 500 feet of a building, fined $80, plus $20 surfine. Pleaded guilty to disturbing the peace, fined $150 but the surfine was waived in this ruling. Charge of disorderly conduct, dismissed on request of the Commonwealth. Must pay probation supervision fee of $65 per month.

Wesley S. Powell, 29, of Chester Street, Athol. Pleaded guilty to being intoxicated while carrying a firearm, sentenced to one year in the house of correction, 30 days direct, and concurrent with the previous case, and with the same conditions as in the previous case. Pleaded guilty to three charges of improper storage of a firearm, sentenced to all the same conditions as in the previous count. Charge of using body armor while attempting to commit a felony, dismissed on request of the Commonwealth.

Admitted to sufficient facts for operating under the influence of liquor, but continued without a finding until 10/3/17, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50, and must do no driving until the Registry of Motor Vehicles reinstates the license. Admitted to sufficient facts for negligent operation of a motor vehicle, but continued without a finding until 10/3/17, plus head-injury assessment of $250. Charge of disturbing the peace, dismissed on request of the Commonwealth.

Stephanie M. Gaudes, 25 of Derry, N.H. Pleaded innocent to possessing a Class E drug, to wit, anabolic steroid, released on personal recognizance, continued to 11/8/16 for pretrial conference.

Richard H. Easton, 46, of Log Plain Road West, Greenfield. Charges of operating with suspended registration, and uninsured motor vehicle, both dismissed on request of the Commonwealth.

Maria C. Biello, 26, of Fourth Street, Turners Falls. Charge of unlicensed operation of a motor vehicle, in Greenfield by state police, to be dismissed on payment of $50 court costs, today. Found not responsible for unregistered motor vehicle.

Richard McFadden, 47, of West Springfield. Charge of unlicensed operation of a motor vehicle, to be dismissed on payment of $100 court costs. Found not responsible for speeding, and motor vehicle lights violation.

Jamie P. Mahar, 43, of Fourth Street, Turners Falls. Charge of number plate violation to conceal identification, to be dismissed on payment of $50 court costs. Charge of uninsured motor vehicle, also to be dismissed on payment of $50 court costs. Found not responsible for unregistered motor vehicle.

Samantha A. McCarthy, 19, of Quincy. Charge of operating a motor vehicle with license suspended, in Greenfield by state police, dismissed prior to arraignment.

Brandon Hogan, 38, of Mohawk Trail, Greenfield. Charge of operating a motor vehicle with license suspended, to be dismissed on payment of $50 court costs.

Robert J. Butynski, 22, of Conway Street, Greenfield. Charge of violation of an abuse prevention order, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the Commonwealth doesn’t have jurisdiction over the prosecution of this matter. This follows a motion that states the incident took place in Vermont, and not in Massachusetts.

Colin S. Bargeron, 32, of Shelburne Falls Road, Conway. Charge of assault and battery on family/household member, in Conway by state police, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after review of the evidence, and continued speaking with both the involved parties, the interest of justice best served by no further prosecution. Must pay legal counsel fee of $150.

William E. Graves, 66, of Bardwells Ferry, Conway. Pleaded innocent to negligent operation of a motor vehicle, in Deerfield by state police, released on personal recognizance, continued to 10/31/16 for pretrial conference.

Pleaded innocent to trafficking in 18 grams or more or less than 36 grams of cocaine, possessing a Class B drug, to wit, cocaine with intent to distribute, subsequence offense, failure to stop/yield, possessing a Class D drug, to wit, marijuana, subsequence, offense, and operating a motor vehicle with license suspended, in Montague by state police, bail set at $250,000 or $500,000 surety, continued to 11/3/16 for bind-over hearing.
