Jacob J. Phelps, 38, of Haydenville. Pleaded innocent to possessing a Class A drug, to wit, heroin, and marked lanes violation, in Bernardston by state police, bail set at $300 cash, continued to 10/25/16 for pretrial conference. Must pay legal counsel fee of $150.

Joseph A. Hayward, 66, of Wells Street, Greenfield. Two charges of assault with a dangerous weapon, a knife in both charges, were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, based on the information available to the Commonwealth on the morning of trial, the Commonwealth can’t meet its burden of proof. Must pay counsel fee of $150, or perform 16 hours of community service.

Orange, Sept. 20Judge David S. Ross

Brianna Powell, 25, of Hamilton Street, Orange. Admitted to sufficient facts for leaving the scene of property damage, but continued without a finding until 11/22/16 with victim witness assessment of $50, and restitution up to $150 yet to be determined. Found not responsible for failure to notify the Registry of motor Vehicles of a name or address change. Charge of negligent operation of a motor vehicle, dismissed on request of the Commonwealth. Must pay legal counsel fee of $150.

Dwayne D. Boudreau, 55, of Perry Road, Orange, Pleaded guilty to possessing a Class B drug, to wit, Acetaminophen/codeine 300 mg, placed on probation until 9/19/17 with victim witness assessment of $50, must sign releases so that the probation office can monitor attendance at programs ordered by the judge. Charge of possessing a Class B drug, to wit, oxycodone and hydrochloride 10 grams, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the defendant provided a letter from the doctor regarding the oxycodone. Found not responsible for failure to notify the Registry of motor Vehicles of a name or address change. Charge of operating a motor vehicle with license suspended, dismissed on request of the Commonwealth. Must pay counsel fee of $150, or perform 16 hours of community service. Must pay $50 per month probation supervision fee.

Heather Hickman, 28, of Phillipston. Charge of operating a motor vehicle with license suspended, in Athol, dismissed on request of the Commonwealth.
