Charges of assault and battery on a person 60 or over and/or disabled, with injury, and intimidating a witness, a juror, police or court official, both were not prosecuted, as according to a statement from a counsel in the district attorney’s office, the alleged victim has been moved by her family to an address in North Carolina; despite multiple contacts via telephone with her, the commonwealth has been unable to obtain an address or telephone number for her; the commonwealth can’t prove the case beyond a reasonable doubt with her testimony.
