Release conditions set for former Shutesbury man facing 29 charges, including rape and strangulation

GREENFIELD — A local man facing 29 charges, including rape and strangulation, will be released from custody if he can identify an appropriate residence to stay at, a Franklin County Superior Court judge has decided.

Branden M. Eugenio, 31, appeared before Judge John Agostini last week and pleaded not guilty to the charges, which were transferred from Orange District Court due to their severity.

Under his release conditions, Eugenio must reside at a location that is acceptable to the court and Franklin County Probation, wear a GPS device, and be under a complete curfew, meaning that he may only leave the residence for medical or legal reasons, and only as approved by probation. Although Eugenio last resided in Shutesbury, the home was sold upon his arrest. Eugenio is also forbidden from having any contact with the alleged victim or their family.

Assistant District Attorney Jillian Parent, who is prosecuting the case alongside colleague Sandra Staub, argued that no amount of bail could ensure the public’s safety.

“Not only is he a danger to the victim, but he’s a danger to the community as well,” she told Agostini, who rendered his decision on Tuesday.

Eugenio faces eight counts of aggravated rape; six counts of strangulation; four counts of assault and battery on a family or household member; two counts each of rape, violation of a restraining order, intimidation of a witness and kidnapping; and single counts of threatening to commit a crime, stalking, and assault and battery by means of a dangerous weapon causing serious bodily injury.

The prosecution alleges that on April 9, Eugenio raped his intimate partner after she denied a request for sex and later choked her while she was driving him to work. According to Parent, Eugenio also threatened to kill the victim, who stopped the vehicle and called 911 after locking herself in a public bathroom. Responding officers reported her clothes were ripped and her appearance was disheveled. According to Parent, Eugenio reportedly told officers his partner initiated the sex earlier that day.

Parent said the victim now deals with chronic headaches and issues with speech and sight following head trauma sustained while Eugenio allegedly dragged her out of a bathroom to sexually assault her. Eugenio also allegedly once struck the victim so violently while she was pregnant that she needed to have an emergency cesarean section, leading to the child’s premature birth.

Parent said Eugenio, who reportedly also faced charges in Palmer District Court, has had five restraining orders filed against him by three people.

Kelly said his client has never been convicted of a crime and that all previous charges have been continued without a finding or dismissed.

“He is a hard-working, blue-collar man,” Kelly said, adding that “allegations are easy to make.”

A pretrial hearing has been set for Oct. 23.
