I would like to see the family of Renee Nicole Good sue (on behalf of her children) the ICE agent who shot and killed her. If Kristi Noem persists in claiming he was justified, she should be sued as a co-defendant. Let a jury of reasonable people decide whether this meets the standard for self-defense.
It seems to me that there will never be a more well-documented case of unjustified homicide by a federal official. And the Supreme Court cases made clear that immunity is qualified, not absolute, and that disregard of clearly established procedures for handling cases is culpable.
It is clear that the federal government that has jurisdiction of the criminal case does not intend to do their duty, but a civil suit in a state court is not under their jurisdiction. A state judge could allow the case to go forward, and if the defendant claims that he is immune from being sued, the plaintiff can go to the Supreme Court to establish that qualified means qualified. The state judge has the duty to allow the plaintiff to have a jury of his peers decide whether the facts, if proved as alleged, constitute liability for damages and to allow the injured family their day in court.
